6th Circ. Rejects $500M LexisNexis Class Arbitration

Law360, Los Angeles (November 05, 2013, 7:16 PM ET) -- The Sixth Circuit on Tuesday found that a Texas lawyer can’t bring a $500 million class arbitration against Reed Elsevier Inc. and its LexisNexis division, saying it must abide by the Supreme Court’s instructions for interpreting arbitration clauses, regardless of the fairness of those deals.

The three-judge appellate panel wrote in Tuesday’s decision that though the arbitration agreement lawyer Craig Crockett and his law firm signed with LexisNexis inarguably and overwhelmingly favored the data provider, he had, ultimately, signed it and it was therefore enforceable....
