Union Pacific Worker's Atty Malpractice Suit Revived

Law360, Los Angeles (November 05, 2013, 10:36 PM ET) -- A California state appeals court on Tuesday reinstated an ex-Union Pacific Railroad Co. machinist's legal malpractice complaint after deciding that conduct by the company's in-house counsel in another worker's Federal Employers Liability Act suit might have caused the machinist to be wrongfully fired.

The appeals court found a triable issue of material fact as to whether Brian Plummer, who served as the lawyer for both Union Pacific and Michael Yanez in the FELA suit, manipulated Yanez's misworded witness statement to benefit the company in that litigation....
