Fed. Circ. Axes E8 Pharmaceuticals' Gene Testing IP Claims

Law360, New York (November 06, 2013, 4:53 PM ET) -- The Federal Circuit on Wednesday ruled that Affymetrix Inc. and Navigenics Inc. have not infringed on a patent covering a method for genetic testing held by E8 Pharmaceuticals LLC, offering a full-throated endorsement of the district court's claim construction.

In a brief opinion, the panel said that Massachusetts U.S. District Judge George A. O'Toole had offered an acceptable construction of a key phrase within the patent that describes the method for creating a reduced complexity genome, or RCG, through the use of a polymerase chain reaction....
