Judge Kicked Off Stop-And-Frisk Cases Rips Removal Ruling

Law360, Los Angeles (November 6, 2013, 8:24 PM EST) -- Lawyers representing U.S. District Judge Shira A. Scheindlin asked the Second Circuit on Wednesday to reconsider its removal of the judge from two stop-and-frisk policing class actions, claiming the order raises "troubling issues" that may warrant en banc review.

Lead counsel Burt Neuborne of the New York University School of Law said a three-judge panel should have allowed Judge Scheindlin to respond to its findings that she "ran afoul" of the judicial code of conduct by compromising her appearance of impartiality.
