9th Circ. Urged To Revive Car Buyer's GMAC Loan Suit

Law360, Los Angeles (November 6, 2013, 9:47 PM ET) -- A California car buyer urged the Ninth Circuit on Wednesday to revive a putative class action that alleged General Motors Acceptance Corp. wrongfully collected loan deficiency payments after vehicles were repossessed, saying he made a sufficient showing that his lender's alleged conduct caused him economic injury.
Roderick Wright argued that GMAC, now known as Ally Financial Inc., violated California's Unfair Competition Law by sending him a defective notice of intent to collect a $9,694 deficiency on his auto loan, and that the violation ultimately caused him...
