GNC Shakes False Label Class Action Over Meal Bars

Law360, Los Angeles (November 07, 2013, 10:16 PM ET) -- A California federal judge on Thursday tossed a putative class action alleging meal replacement bars sold in General Nutrition Centers Inc. stores deceived customers into thinking the bars were healthy because they were labeled “zero impact.”

U.S. District Judge S. James Otero granted a motion to toss the suit against GNC and Vital Pharmaceuticals Inc., the maker of the bars, writing in Thursday’s decision that it was up to the U.S. Food and Drug Administration to determine whether the labeling was misleading.
