Full Fed. Circ. Won't Review Apple Win In Motorola ITC Fight
By Ryan Davis
Law360, New York (November 8, 2013, 8:03 PM ET) -- The full Federal Circuit on Friday decided not to review a decision reviving a U.S. International Trade Commission patent suit brought against Motorola Mobility Inc. by Apple Inc., rejecting Motorola's argument that the decision was "completely divorced" from the U.S. Supreme Court's obviousness precedents.
The appeals court denied without comment a September petition the Google Inc. unit filed seeking an en banc rehearing of an August panel decision that reversed the ITC's finding that an Apple touch-screen patent was obvious.
