Colgate Can Sue Insurer For Legal Fees In Asbestos Suits

Law360, New York (November 08, 2013, 8:59 PM ET) -- A New York judge has ruled that Colgate-Palmolive Co. can proceed with its countersuit seeking insurer OneBeacon America Insurance Co.'s coverage of legal fees that Colgate had paid to Quinn Emanuel Urquhart & Sullivan LLP, which defended the company against asbestos lawsuits.

In a 42-page, Nov. 4 decision, New York Supreme Court Judge Carol Robinson Edmead denied OneBeacon’s motion to dismiss several of Colgate’s counterclaims, including for breach of implied covenant of good faith and fair dealing, but agreed to nix some of Colgate’s counterclaims against reinsurers...
