Trade Groups Ask High Court To Nix State IP Immunity

Law360, New York (March 3, 2008, 12:00 AM EST) -- Trade groups representing business and technology companies are urging the U.S. Supreme Court to cure the “inequity and imbalance” caused by a state's ability to claim immunity from intellectual property claims in federal courts.

The U.S. Chamber of Commerce and the Software & Information Industry Association filed an amici curiae brief last month asking the High Court to rule on whether a federal appeals court erred in allowing California's Department of Health Services to assert its Eleventh Amendment sovereign immunity rights to dismiss a patent suit....
