Noel Canning Urges High Court To Limit Recess Appointments

Law360, New York (November 19, 2013, 6:55 PM ET) -- Soda bottler Noel Canning told the U.S. Supreme Court on Monday that in seeking to overturn the D.C. Circuit's ruling invalidating the president's recess appointments to the National Labor Relations Board, the executive branch is asking for “a virtually unlimited unilateral appointments power.”

In a brief filed Monday in the NLRB's high court appeal of the D.C. Circuit's decision, the company — whose appeal of an adverse board decision led to the appeals court's blockbuster ruling — urged the court to uphold the decision nixing the recess appointments....
