Equipment Co. To Pay Up To $3.3M To Settle Fax Spam Suit

Law360, Chicago (November 21, 2013, 2:20 PM EST) -- A California federal judge on Wednesday granted initial approval to a settlement worth up to $3.3 million in a class action accusing equipment leasing company Balboa Capital Corp. of sending out nearly a million nuisance fax ads.

Irvine, California-based Balboa — which allegedly ran afoul of the Telephone Consumer Protection Act with improper opt-out notices in fax ads it sent between 2007 and 2011 — will pay a minimum of $2.3 million and no more than $3.3 million to settle the suit, according to a preliminary...
