5th Circ. Overturns Office Sniffing Sex Harassment Ruling

Law360, Los Angeles (November 22, 2013, 4:52 PM EST) -- The Fifth Circuit on Thursday revived a woman's claim her company illegally fired her after she complained of sexual harassment when two men constantly sniffed her suggestively while she sat at her desk.

The three-judge panel found there were genuine disputes of fact in the magistrate judge’s decision that there was no causal link between Tonia Royal’s sexual harassment complaint and her firing just four days after she started her job as a leasing manager at an apartment complex in Texas, according to Thursday’s ruling....
