Biosig Asks High Court To Skip Patent Indefiniteness Case

Law360, New York (November 27, 2013, 6:21 PM EST) -- Biosig Instruments Inc. urged the U.S. Supreme Court recently to reject an appeal by Nautilus Inc. in a case over a heart monitor patent, saying that contrary to Nautilus' arguments, the Federal Circuit does not have an overly permissive standard for deciding whether patents are indefinite.

The Federal Circuit ruled in April that Biosig's patent was valid because the claims were not "insolubly ambiguous," but Nautilus, of which Biosig accused infringement, said in its high court appeal that such a standard dilutes the Patent Act's requirement...
