Sovereign Immunity Bars Same-Sex Marriage Suit, Pa. Says

Law360, Philadelphia (December 03, 2013, 3:30 PM ET) -- Gov. Tom Corbett’s administration argued Monday that a lawsuit brought by a suburban Philadelphia couple challenging the constitutionality of Pennsylvania’s ban on same-sex marriage was barred by principles of sovereign immunity.

In a brief filed in Commonwealth Court, the administration said that a lawsuit brought by Nicola and Tamara Cucinotta challenging a 1996 state law defining marriage as between one man and one woman was barred because it was brought generally against the state and not against a specific official responsible for administering the statute....
