ACE Avoids $3M Share Of Seagram Distillery Settlement

Law360, New York (December 5, 2013, 6:08 PM EST) -- An Indiana appeals court on Thursday freed ACE American Insurance Co. from chipping in $3 million toward the settlement of a class action that property owners brought over ethanol emissions from a Seagram distillery, but allowed the plaintiffs' bad faith claim against the insurer to proceed anyway.

According to the ruling, ACE was not bound by a settlement agreement between the class, and defendant Pernod Ricard USA LLC, doing business as Seagram Lawrenceburg Distillery, and its insurer XL Insurance America.
