Volkswagen Dodges Suit Over Faulty Jetta Locks

Law360, Los Angeles (December 5, 2013, 9:02 PM EST) -- A Florida federal judge on Thursday tossed a married couples’ putative class action against Volkswagen Group of America Inc. alleging locks on their Jetta sedan were defective, ruling they were time-barred from bringing express warranty and deceptive practices claims.

U.S. District Judge James I. Cohn dismissed the plaintiffs’ express warranty claim because the warranty expired nearly a decade before their door locks malfunctioned and because the two-year limit on Volkswagen’s warranty was not unconscionable.
