ITC To Review Infringment Finding In Nokia-HTC Patent Row

Law360, Los Angeles (December 11, 2013, 5:49 PM EST) -- The U.S. International Trade Commission will review an administrative law judge’s determination that some HTC Corp. smartphones infringed two Nokia Corp. patents, saying Monday it will reconsider the judge’s striking of expert testimony and findings on claim construction and infringement.

The decision comes one month after HTC asked the commission to send the case to a different judge, arguing the ALJ had abused his discretion in denying HTC’s submission of expert testimony in the case and wrongly ruled that HTC waived arguments in the investigation....
