ASUS Can't Dodge Netgear's Router False Ad Suit

Law360, Los Angeles (December 12, 2013, 8:17 PM ET) -- A California federal judge on Thursday refused to dismiss Netgear Inc.'s antitrust and false advertising suit alleging Taiwanese electronics company ASUSTeK Computer Inc. reported misleading information related to its network routers’ signal strength, in violation of Federal Communications Commission regulations.

In September, ASUS and its California-based subsidiary ASUS Computer International moved to dismiss the complaint, saying it usurped the FCC’s exclusive authority to enforce its own regulations and that it couldn't offer a plausible explanation for how Netgear’s alleged damage was caused by the conduct.
