Drug Giants Broker $125M Deal In AWP Suit

Law360, New York (March 10, 2008, 12:00 AM EDT) -- A host of major pharmaceutical makers have agreed to fork over $125 million as part of a nationwide settlement in the multidistrict litigation over average wholesale drug prices filed by consumers and insurance companies.

Under the terms of the deal, filed Friday in the U.S. District Court for the District of Massachusetts, the drug companies – including Abbott Laboratories, Aventis Pharmaceuticals Inc., Baxter Healthcare Corp., and Watson Pharmaceuticals Inc., among others – will hand over 82.5% of the $125 million fund to third-party payors.
