Target Dodges Age-Bias Class Action

Law360, New York (December 20, 2013, 7:49 PM ET) -- An Arizona federal judge on Thursday threw out a putative class action accusing Target Corp. of pushing out older workers in violation of federal age-discrimination law, saying plaintiff Katy Rodriguez hadn’t provided evidence that the retailer had forced her to retire.

U.S. District Judge Jennifer Zipps granted Target’s motion for summary judgment Thursday, ruling Rodriguez couldn't pursue a class action against the retailer because she had failed to show that she herself had suffered an adverse employment action.
