Brand Success A Double-Edged Sword For Starbucks

Law360, New York (January 12, 2006, 12:00 AM EST) -- Coffee giant Starbucks, accustomed to prevailing in trademark infringement suits worldwide, has recently been dealt a rare blow by a federal judge, who ruled that a New Hampshire coffee company can continue to sell its Charbucks brand coffee beans.

The judge ruled that Starbucks failed to prove that its business had been harmed by Charbucks. The judge also said that consumers were not likely to confuse Starbucks with the Charbucks and Mister Charbucks coffee beans sold by New Hampshire company Black Bear Micro Roastery.
