Delphi Seeks To Head Off Infringement Action

Law360, New York (March 12, 2008, 12:00 AM EDT) -- Bankrupt auto parts maker Delphi Corp. has asked a federal court to affirm that four patents for a Passive Occupant Detection System, or PODS, are invalid and unenforceable and that Delphi has not infringed them.

Automotive Technologies International Inc., which holds the patents, has sued several major automakers for infringement.

Delphi filed a complaint against Denver, N.C.-based auto safety research company ATI on Monday in the U.S. District Court for the Eastern District of Michigan, seeking declaratory judgment on the patents.
