Hershey Kills Attempt At 'Milkshake' Mark At TTAB

Law360, New York (January 6, 2014, 7:11 PM EST) -- The Hershey Co. has won an opposition before the Trademark Trial and Appeal Board, which ruled that a New York man couldn't register the trademarks “milkshake” or “milk shake” for selling candy bars because the chocolate giant already uses them on its Whopper and Kit Kat brands.

Applicant Kenneth B. Wiesen had argued, among other things, that Hershey abandoned the name when it acquired Hollywood Candy in the mid-1990s and subsequently discontinued Hollywood's long-produced Milkshake bar.
