Cotton Cos. Want Arbitration Of Farmers' Contract Fight

Law360, Houston (January 9, 2014, 8:48 PM EST) -- The Texas Supreme Court was asked Thursday to reject a trial court’s decision to invalidate an arbitration agreement on the basis of an unfair attorneys' fee provision and damages limitations instead of severing the offending clauses in a dispute over a cotton supply agreement.

Noble Americas Corp. and Venture Cotton Cooperative said the trial court should have granted the companies’ motions to compel arbitration against a group of farmers who sued to challenge terms of their contracts for the companies to sell and market their cotton....
