Parallel Investigation Violated Rights: Judge

Law360, New York (January 17, 2006, 12:00 AM EST) -- A federal judge has accused the Securities and Exchange Commission and the U.S. Attorney’s Office of "deceit and trickery" that violated the rights of defendants in a coordinated investigation of alleged securities fraud.

The ruling at the U.S. District Court for the District of Oregon has brought into question the use of parallel investigations by the agencies and the extent to which their cooperation might violate defendants’ rights to due process under the Fifth Amendment.
