CenturyTel Can't Shake DSL Patent Infringement Claims

Law360, Los Angeles (January 15, 2014, 9:05 PM EST) -- A Florida federal judge refused Wednesday to strip claims from a suit accusing CenturyTel Broadband Services LLC of willfully infringing Brandywine Communications Technologies LLC's DSL technology patents after finding evidence CenturyTel knew of the patents before the suit was filed.

U.S. District Judge Charlene Edwards Honeywell granted in part Brandywine's motion for judgment on the pleadings, ruling that CenturyTel may have had pre-suit knowledge of the patents because the plaintiff had hit its parent company, CenturyLink Inc., with similar allegations in a previous suit.
