High Court May Tighten Patent Standards To Blunt Trolls

Law360, New York (January 16, 2014, 7:21 PM EST) -- A case recently taken by the U.S. Supreme Court could require patents to be written with greater specificity and make it easier to invalidate those with vague language, which attorneys say could hamper the litigation tactics of so-called patent trolls.

The justices agreed Friday to hear an appeal by Nautilus Inc. challenging the test used by the Federal Circuit to determine when a patent is invalid as indefinite, which Nautilus claims makes it too hard to invalidate patents with vague or confusing claims.
