Climate Change: Legislation And Litigation

Law360, New York (March 14, 2008, 12:00 AM EDT) -- It is very unlikely that the 110th Congress will enact comprehensive climate change legislation.

However, with both houses of Congress under the control of the Democratic Party, and with the three top presidential contenders all supporting climate change legislation, the prospects are more likely in 2009 than ever before.

Any successful legislative vehicle will likely be based on one of the competing models currently before the legislature:
