Fla. Same-Sex Marriage Ban Is Unconstitutional, Suit Says

Law360, Miami (January 21, 2014, 6:47 PM ET) -- A highly anticipated legal challenge to Florida's ban on same-sex marriage was launched on Tuesday as six same-sex couples and the Equality Florida Institute filed a lawsuit in state court in Miami claiming the state's laws violate the U.S. Constitution.

The complaint, filed after the six couples applied for and were denied marriage licenses Friday, seeks declaratory and injunctive relief on the grounds that the Florida Constitution and two state laws violate the due process clause and the equal protection clause of the Fourteenth Amendment....
