Toxic Tort Against Weyerhaeuser Gets Go-Ahead

Law360, New York (March 17, 2008, 12:00 AM EDT) -- A suit brought by hundreds of residents of an Arkansas town who claim pollution by Weyerhaeuser Co. made them sick will go forward after a judge rejected the lumber company's motion to have the case dismissed.

In a ruling last week, Judge Harry F. Barnes of the Western District of Arkansas denied two motions by Weyerhaeuser, one to dismiss the case and one seeking more details in the complaint filed by the plaintiffs.
