Landowners Can Fight Annexation, Ind. High Court Says

Law360, New York (January 22, 2014, 3:42 PM EST) -- In a reversal of a state court opinion, the Indiana Supreme Court on Tuesday decided to allow 200 landowners to fight against the city of Boonville's attempted annexation of more than 1,000 acres of property for a public road project.

In a Tuesday opinion, the Indiana Supreme Court said that the appeals court had improperly calculated the number of property owners required to fight an annexation in the state because it had counted the land in multiple parcels instead of as one unit.
