TTAB Refuses Nestle's 'Stay Strong! Stay Active!' Trademark

Law360, New York (January 23, 2014, 4:18 PM ET) -- A federal trademark appeals panel ruled last week that Nestlé S.A. couldn't register a trademark for "Stay Strong! Stay Active!” for nutritional supplements, declaring it too similar to an already-registered mark for “Stay Activ.”

Nestle uses the slogan to sell its Boost line of nutrition drinks, but the Trademark Trial and Appeal Board ruled on Jan. 15 that the Swiss food and beverage giant couldn't register it as a federal mark because two Tennessee men have had the “Stay Activ” mark on the books since 2009....
