'Natural' Labeling Row Remains FDA's Domain, Gruma Says

Law360, New York (January 27, 2014, 8:21 PM EST) -- Gruma Corp. argued Friday that a proposed food labeling class action in California should be dismissed on jurisdictional grounds, even though the U.S. Food and Drug Administration recently refused to determine whether genetically modified food can be marketed as “natural.”

U.S. District Judge Yvonne Gonzalez Rogers stayed the case in July and asked the FDA to weigh in on the claims, which in this case accuse Gruma of mislabeling its Mission Restaurant Style tortilla chips as “all-natural” when they contain genetically modified corn. The FDA refused...
