Family Dollar Wants High Court To Tackle Pay Bias Action

Law360, New York (January 31, 2014, 7:21 PM EST) -- Family Dollar Stores Inc. urged the nation's highest court to reverse a Fourth Circuit decision reviving a putative class action accusing the store chain of paying female managers less than males, claiming the appeals court's reasoning conflicted with the high court's landmark Dukes ruling.

Family Dollar's petition for certiorari not only argued that the Fourth Circuit's ruling contravened Wal-Mart v. Dukes, but that the appeals court lacked jurisdiction to tackle the lower court's decision to deny the women a chance to lodge an amended complaint....
