NLRB Ignored Evidence In Contractor Ruling: FedEx

Law360, New York (March 19, 2008, 12:00 AM EDT) -- FedEx Home Delivery has filed a brief in its appeal of a National Labor Relations Board decision that found the company had misclassified employees working out of two Massachusetts distribution centers as independent contractors.

In the brief, filed Monday in the U.S. Court of Appeals for the District of Columbia Circuit, the FedEx Corp. subsidiary claims the NLRB’s decision should be reversed because the board’s regional director had improperly excluded evidence provided by FHD in reaching his conclusion in September 2006.
