Retailers Lose Bid To Invalidate Gift Card Patent

Law360, New York (March 20, 2008, 12:00 AM EDT) -- An Illinois federal judge has allowed an infringement case against Barnes & Noble Inc. and Aeropostale Inc. to proceed after denying claims that MedCom USA Inc.'s patent for prepaid phone and gift card technology is invalid.

U.S. District Judge Joan B. Gottschall of the Northern District of Illinois ruled on Tuesday against Aeropostale's motion for summary judgment that MedCom's patent is invalid for indefiniteness.
