Bid To Silence Blogger Unconstitutional: Fla. Appeals Court

Law360, New York (February 6, 2014, 2:59 PM EST) -- A Florida state appeals court ruled Wednesday that a trial court's injunction barring a former tenant from posting critical blog entries about her landlord was an unconstitutional prior restraint on speech.

The Florida Third District Court of Appeal overturned an injunction granted to Raanan Katz and RK Associates prohibiting Irina Chevaldina, a former tenant at a Katz-owned commercial site, from posting any further “defamatory blogs.”
