9th Circ. Sides With Coca-Cola Bottler In $19M Wage Suit

Law360, Los Angeles (February 18, 2014, 10:43 PM EST) -- The Ninth Circuit on Tuesday rejected an appeal from the plaintiffs in a $19 million putative class action alleging a Coca-Cola bottler’s pay stubs were confusing to hourly wage employees, finding the wage information could be determined using simple math.

In an unpublished memorandum opinion, the three-judge panel sided with the district court’s ruling, which tossed plaintiff Isaias Hernandez’ claims after determining that wage statements that require employees to do “simple math” to calculate their pay do not constitute an injury under state labor laws....
