Law360, New York (March 19, 2014, 10:39 PM EDT) -- There have been several recent cases addressing claims for misappropriation of trade secrets and for violation of the Consumer Fraud and Abuse Act ("CFAA"). In New South Equipment Mats LLC v. Keener, a federal district court in Mississippi addressed whether a former employer's claims for violations of the Consumer Fraud and Abuse Act sufficiently pled damage or loss as required under the statute and also whether certain state law claims were preempted by the Mississippi Uniform Trade Secrets Act.
