Staff Agency Not Liable For Employee Poisoning, Panel Says

Law360, Los Angeles (February 21, 2014, 4:07 PM EST) -- A California appellate panel on Friday tossed a liability and negligence suit against staffing agency AMN Healthcare brought by a medical assistant who was poisoned by a co-worker hired by AMN, ruling AMN was not responsible for the employee’s misbehavior.

Court of Appeals Justice James A. McIntyre upheld a lower court’s grant of summary judgment, finding that the incident was “highly unusual and startling” and outside of the scope of the co-worker’s employment with AMN, which does business as Nursefinders.
