Magazine Co. Seeks Reversal Of 9th Circ. $34M FTC Award

Law360, New York (March 7, 2014, 6:38 PM EST) -- A magazine subscription company has asked the U.S. Supreme Court to nix a Ninth Circuit decision giving the Federal Trade Commission a second chance to recover $34.4 million that the company allegedly stole from consumers through deceitful magazine sales.

Publishers Business Services Inc. claims the FTC shouldn’t be able to get “virtually unlimited legal relief” for the alleged losses, and argued the appeals court threw out a “carefully reasoned monetary award” when it determined the lower court misapplied the FTC Act.
