Pa. Court Says Amusement Park Death Suit Belongs In NJ

Law360, New York (March 11, 2014, 12:28 PM EDT) -- The Pennsylvania Superior Court on Monday ruled that a suit brought by the family of an 11-year-old girl who fell from a Ferris wheel and died at a New Jersey amusement park belongs in that state, overturning a trial court ruling.

The three-judge appeals panel said in an opinion written by Judge Mary Jane Bowes that both private and public factors weighed in favor of transferring the case to New Jersey, where the tragic incident occurred and where most witnesses lived and were employed.
