Warranty Claims Busted In Ford Cracked Tailgate Dispute

Law360, New York (March 12, 2014, 6:20 PM EDT) -- A California federal judge on Tuesday trimmed a consolidated putative class action alleging Ford Motor Co. knowingly sold or leased to consumers sport utility vehicles containing defects that caused cracks in the tailgate, then refused to repair the cracks under warranty.

U.S. District Judge Richard Seeborg partially granted Ford’s motion to dismiss, agreeing to nix the plaintiffs’ state law express and implied warranty claims as well as other state tort claims given that the consolidated complaint doesn’t assert the alleged defect manifested during the warranty period...
