ND High Court Revives Challenge To Urban Renewal Tax Plan

Law360, New York (March 14, 2014, 8:30 PM EDT) -- North Dakota's highest court reversed a lower court ruling Friday, saying a resident's suit for declaratory relief in a dispute over the city of Bismarck's urban renewal plan can proceed.

Erling Haugland, a Bismarck resident who owns land in Bismarck and Lincoln, claims Bismarck violated state and federal laws by setting up an urban renewal plan and using tax increment financing for the downtown renewal project.
