EEOC Sues Maxim For Refusing To Hire HIV-Positive Man

Law360, Philadelphia (March 18, 2014, 5:44 PM ET) -- The U.S. Equal Employment Opportunity Commission accused Pittsburgh-based medical staffing firm Maxim Healthcare Services Inc. of refusing to hire an HIV-positive applicant because of his disability, in a suit filed Monday in Pennsylvania federal court.

The EEOC said that the company violated the Americans With Disabilities Act when it pulled back an employment offer that involved sitting with patients at a U.S. Department of Veterans Affairs medical facility after the individual revealed his status on a required health-status certification.
