Ruling Finds EEOC Misclassified Workers As Exempt

Law360, New York (April 2, 2008, 12:00 AM EDT) -- In an ironic turn of events for the U.S. Equal Employment Opportunity Commission, an arbitrator has found that the agency violated a federal labor law by misclassifying some of its own investigators and mediators as exempt from overtime compensation.

Arbitrator Stephen M. Wolf determined that the EEOC made a mistake when it changed the status of certain investigators and mediators to exempt under the Fair Labor Standards Act's administrative exemption, according to a March 23 ruling.
