Judge Keeps Fraud Claims In Monster Trademark Suit

Law360, New York (April 7, 2008, 12:00 AM EDT) -- A federal judge has denied cable manufacturer Monster Cable Products Inc.’s motion to dismiss claims from a patent and trademark dispute brought against the company by its rival Audiovox Corp.

On Monday, Judge Leonard D. Wexler of the U.S. District Court for the Eastern District of New York refused to dismiss two claims from Audiovox’s complaint seeking declaratory judgment of noninfringement and invalidity of a patent and trademark held by Monster Cable.
