8th Circ. Decertifies Class In St. Jude Valve Case

Law360, New York (April 9, 2008, 12:00 AM EDT) -- An appeals court judge has decertified a class of 11,000 plaintiffs who received one of St. Jude Medical Inc.’s allegedly defective Silzone heart valves, ruling that individual questions would predominate in the plaintiffs' cases.

Judge Steven Colloton's decision, handed down in the U.S. Court of Appeals for the Eighth Circuit on Wednesday, overturned a 2006 ruling by the U.S. District Court for the District of Minnesota that all the plaintiffs in the multidistrict litigation could bring claims under Minnesota consumer protection laws.
