Pa. Town Not Liable For Shoddy Condo Construction: 3rd Circ.

Law360, Los Angeles (April 11, 2014, 10:46 PM ET) -- A Pennsylvania municipality and its employees aren't liable for the faulty construction of a condominium complex that was later condemned, the Third Circuit ruled on Friday, agreeing with a lower court that a group of former residents of the complex failed to plead a violation of their substantive due process rights.
In a nonprecedential opinion, a three-judge panel affirmed U.S. District Judge Eduardo C. Robreno's decision dismissing the plaintiffs' due process claims, finding that the defendants' alleged actions at most amounted to negligence or incompetence. ...
