Fifth Third Bank Hit With FLSA Suit

Law360, New York (April 18, 2008, 12:00 AM EDT) -- A former employee hit Fifth Third Bank with a putative collective action Thursday, accusing the bank of deliberately misclassifying her position in order to deny her and other workers overtime pay.

Plaintiff Arti Joshi lodged the complaint in the U.S. District Court for the Middle District of Florida alleging the bank wrongly listed her job as an “investment adviser sales support assistant” as exempt from overtime pay, violating the Fair Labor Standards Act.
